Florida Supreme Court rules that counselor can be sued for revealing secrets disclosed to him

In the case of the Donna Gracey and Joseph Gracey vs. Donald Eaker (a marriage counselor) The Florida Supreme Court ruled today, Dec. 19, 2002, that a marriage counselor can be sued for revealing information given to him in confidence by his clients. A rule that lawsuits can seek damages for emotional distress only if there has been an underlying physical injury doesn't apply in this case, Justice R. Fred Lewis wrote for the majority. Justice Lewis wrote, "Donald Eaker is accused of 'revealing the most confidential of information disclosed to him by each individual' ". [Source: Naples Daily News]
